By downloading, installing, or using the Smart NFC application (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
Smart NFC is a mobile application that allows you to:
Certain features of the App (Smart Tags) require you to create an account using Sign in with Apple or email/password. You agree to provide accurate information and to keep your credentials secure.
You are solely responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.
You may delete your account at any time from within the App. Deleting your account will permanently remove all your Smart Tags, analytics data, uploaded files, and account information. This action cannot be undone.
The App offers certain features for free and additional premium features available through a subscription.
Subscriptions are billed through Apple's App Store. All payments are processed by Apple and are subject to Apple's terms and conditions.
You may cancel your subscription at any time through your Apple ID settings. Refund requests are handled by Apple in accordance with their refund policy. Upon cancellation, you retain access to premium features until the end of the current billing period.
We reserve the right to modify subscription pricing. Any price changes will take effect at the start of the next billing period following notice of the change.

We reserve the right to suspend or terminate your account if you violate these Terms.
You are solely responsible for the content you associate with your Smart Tags. We do not review, monitor, or endorse Smart Tag content.
Smart Tags rely on cloud infrastructure (Firebase). While we strive for high availability, we do not guarantee uninterrupted access to Smart Tag content. Temporary service disruptions may occur due to maintenance, updates, or circumstances beyond our control.
You may activate or deactivate your Smart Tags at any time. Deactivated tags will display an inactive page when scanned.
The App writes data to physical NFC tags. You are responsible for ensuring you have the right to write to any NFC tag you use.
The App offers an option to permanently lock NFC tags after writing. This action is irreversible. A locked tag can never be rewritten or erased. NBApps is not responsible for any loss resulting from locked tags.
The App supports NTAG 213, NTAG 215, and NTAG 216 tags. Compatibility with other tag types is not guaranteed.
The App, including its design, code, features, and content, is owned by NBApps and is protected by intellectual property laws. Nothing in these Terms grants you any right to use the NBApps name, logos, or trademarks.
You retain ownership of all content you create or upload through the App. By using the App, you grant NBApps a limited, non-exclusive license to store and deliver your content as necessary to provide the service.
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to:
To the maximum extent permitted by applicable law, NBApps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
You agree to indemnify and hold harmless NBApps from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
The App is not intended for children under the age of 13 (or 16 in the EU/EEA). By using the App, you confirm that you meet this age requirement. We do not knowingly collect personal information from children. If you believe a child has created an account, please contact us and we will promptly delete it.
We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App.
We may update these Terms from time to time. We will notify you of material changes by:
Continued use of the App after any changes constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of France. Any disputes arising from these Terms or the use of the App shall be submitted to the exclusive jurisdiction of the competent courts of France.
For users outside of France, these Terms do not limit any consumer protection rights that may apply under your local law.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
